The last will & testament of Charly Derick, late of the Town of Brunswick in the County of Rensselaer, state of New York, deceased. (Recorded the 27th day of July in the year of our Lord, 1813.)
I CHARLY DERICK considering the uncertainty of this mortal life and being of sound, discerning mind and memory (Blessed be Almighty for the same) do make and publish this my last will and testament in manner and form following (that is to say)
First I give and devise unto my beloved wife MARGARET DERICK the orchard & one acre of corn ground & 4 acres of meadow land and the Garden all lying and being on the Farm which I now live at the ---- of in the Town of Brunswick and County aforesaid to have and to hold and occupy during her natural life and I also give and bequeath to my wife Margaret 2 cows and 2 horses which are to be chosen by her and pastured and kept by SAMUEL DERICK or ADAM DERICK as long as the said Margaret chooses to keep them. I also give and bequeath 2 beds with bedding and sufficient furniture to keep house if she chooses
Item - I give and bequeath to my son CONRAD DERICK Twenty-five Dollars lawful money of the United States -
Item - I give and bequeath and devise unto my son SAMUEL DERICK, his heirs and assigns forever one hundred and twelve acres of land, it being that part of my said farm on which the said Samuel Derick at the date hereof is living and occupying, situate & being in the Town of Brunswick of County aforementioned. -
Item - I give and devise unto my daughter ELIZABETH WEAVER all ---- that lot and one half of ground situate lying and being in the second division of the village of Lansingburgh in the County aforesaid, with the appurtenances thereunto belonging and on which at the date hereof the said Elizabeth Weaver and LEWIS WEAVER her husband live and reside, to hold the same to the said Elizabeth for and during the natural life of her, the said Elizabeth Weaver, and after her decease I give and devise the same lot and one half ground and the appurtenances last aforesaid to the children and heirs of the said Elizabeth Weaver by the said Lewis her husband begotten, to be equally divided among them. -
Item - I give and bequeath unto my son DAVID DERICK one hundred and forty five dollars, lawful money of the United States. -
Item - I give and bequeath unto my son JOHN DERICK one hundred and seventy five dollars lawful money of the United States. -
Item - I give and bequeath unto my daughter ELIZABETH WEAVER one hundred and forty dollars lawful money of the United States. -
Item - I give unto my daughter LANA WICKWIRE, wife of JAMES WICKWIRE, one hundred and forty dollars, lawful money of the United States. -
Item - I give and bequeath to my daughter CATHARINE CLARK, wife of ROWLAND CLARK, one hundred and forty dollars lawful money of the United States, each respectively which said several legacies or sums of money I will order and direct to be paid to the said respective legatees by Samuel Derick and Adam Derick equally, that is to say, the one half to be paid by Samuel Derick and the other half to be paid by Adam Derick, the whole to be paid to the respective legatees within seven years after my decease in the following manner, to wit: Twenty five Dollars to each legatee yearly and every year 'till the whole is paid. I hereby order and direct that a note and account which I have against the said ---- land of LANA WICKWIRE amounting to forty one dollars are to be deducted out of the sum of one hundred and forty dollars bequeathed aforesaid to the said Lana Wickwire. -
Item - I give and bequeath to my son ADAM DERICK one hundred and twenty five acres of land being the residue and that part of my farm on which the said Adam Derick is now living and occupying, situate, lying and being in the Town of Brunswick and County aforesaid, excepting that quantity of land which is already before devised to Margaret Derick, to have and to hold and the said land to him the said Adam Derick his heirs and assigns forever. And it is my will that Adam Derick shall take care of and support the said Margaret Derick my beloved wife after my decease during her life. I give and bequeath to my sons Samuel and Adam Derick my farming utensils and also my wearing apparel and lastly as to all rest residue and remainder of my personal property, goods and chattels of what kind and nature soever I give and bequeath to my daughters ELIZABETH WEAVER, LENA WICKWIRE, CATHERINE CLARK, NELLY MOREY and MARIA MOREY, to be equally divided among them, share and share alike, after the expenses of my funeral charges and debts are paid and satisfied out of the same. -
And I hereby appoint ADAM YATES of the town of Brunswick and JAMES ADAMS of the Town of Lansingburgh in the county aforesaid, the executors of this, my last will and testament, Hereby revoking all former wills by me made -
In witness whereof I have hereunto set my hand and seal the 20th day of July in the year of our Lord, one thousand eight [hundred] and twelve.
Signed, sealed, published by the above named Charly Derick to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses of the testator.
