Last Will and Testament

This will is from Oswego County, New York Surrogate Court Book E pages 54 to 56, as submitted by John Hills. The testator grew up in Rensselaer County, NY and moved to Hannibal, Oswego County, NY during the 1830s.

Such application, this Surrogate did ascertain by satisfactory proof were the widow, heirs at law and next of kin of the said deceased and their respective place of residence, some of whom appearing to be minors having no personal guardian residing in this State, a special guardian was therefore appointed by the Surrogate for the purpose of taking care of the interest of said minors in the Matter of proving said will by an order for that purpose duly entered by said Surrogate. And the said Surrogate did thereupon issue a citation in the form of law to the said widow, heirs at law and next of kin and special guardian by their respective names stating their respective place of residence requiring them to appear before the said Surrogate at his office in the City of Oswego on the 20th day of March 1854 to attend the probate of said will. And afterward to wit on the day and at the place last aforesaid satisfactory evidence was produced and furnished to said Surrogate of the Service of said Citation in the mode prescribed by law and on that day no one appearing to oppose the probate of said will such proceedings were thereupon had that the Surrogate took the proof of said will hereinafter set forth on this 20th day of March 1854 and he adjudge the said will to be a valid will of real and personal property and the proof thereof to be sufficient which said last will and testament and the proofs are as follows that is to say:

I JOHN CHAPMAN of Hannibal in the County of Oswego and State of New York being of sound mind and memory do make and declare this my Last Will and Testament in manner and form as follows:

First I do hereby devise and bequeath unto my wife ANNIS CHAPMAN for and during the term of her natural life my farm of land situated in the town of Hannibal and now in my occupancy and my personal property also that she shall own and control the said property during her natural life. That I desire and will after the demise of the said Annis Chapman my said wife that the said farm of land shall be equally shared and divided unto my two sons JONATHAN B. CHAPMAN and IRA H. CHAPMAN. But in case of the death of Jonathan Chapman that one half of his share of the said farm is to be held and owned by ANTOINETTE the wife of the said Jonathan and the other half of the said share of Jonathan shall be equally divided with my other children.

And I appoint my wife ANNIS CHAPMAN as executrix and GARDNER WOOD and JONATHAN CHAPMAN as executors of this my Last Will and Testament.

Signed Sealed Published and Declared by the said Testator Signed John Chapman as his Last Will and Testament in presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto this tenth day of June 1848
