A copy of the last Will and Testament of Andrew Weatherwax deceased with the proof thereof recorded Dec. 1st 1810
In the name of God amen I Andrew Weatherwax of the town of Schaghticoke in the county of Rensselaer and state of New York being weak ---- -- body but of sound mind & memory blessed be Almighty God for the ---- do make and publish this my last will and testament .
First after the payment of all my debts and funeral expenses I give and bequeath and devise unto my wife Elenor Weatherwax the one third of all my real and personal property of what kind name or nature so ever of which I as said or pro--- at the time of my decease for and during her natural life.
Secondly I give and devise unto my daughter Rachel Baker the one equal third part of the remaining two Thirds of all my real & personal estate & property whatsever for and during her natural life and after the death of said Rachel Baker to her heirs forever.
Thirdly I give and devise unto my son John Weatherwax the one equal third part of the two thirds parts of all my real & personal property whatsoever to his heirs and assigns forever.
Fourthly I give and devise unto my son Stephen Weatherwax the remaining equal third part of the two Thirds parts of all my real & personal property whatsoever to his heirs and assigns forever.
And my will is that my wife Elenor Weatherwax and my three children should all live together and that my real property should not be divided among them in manner above mentioned til all my children above named shall arrive at the age of twenty one years. But should my wife Elenor again marry or die before all my three children above named should arrive at the age of twenty one years in either of which cases my will is that the property be divided among my three children above named in the manner above expressed and written in order that they may ---lly have the use and benefit of the same. And I do hereby appoint my ---- wife executrix and my brother John Weatherwax executor of this my last Will and Testament.
In witness whereof I have hereunto set my hand and seal The fourteenth day of November in the year of our lord one thousand eight hundred and ten.
