Copy of the last will and testament of Abner Dwelly, deceased. Recorded October 18th, 1803. State of New York Rensselaer County.

In the name of God Amen, I, Abner Dwelly of the Town of Schaghticoke in the county of Rensselaer and state of New York having arrived to that age when the infirmities of the body furnish daily proof of the uncertainly of life & considering it a duty to make such an arrangement of the little property I possess among my heirs as will prevent any contest between them respecting the same after my Death & being of sound & perfect mind & memory (_____ be almightily God for the same) do make & publish this my last will & testament in manner following that is to say I do give & bequest to my two sons Abner Dwelly Junior & Lemuel Dwelly & to their lawful heirs & assign forever one hundred acres of land on the west end of my farm lying in said town of Schaghtichoke on which I now live to be divided equally between them provided they comply with the conditions on which said devise is _____ which I shall hereafter explain. I do give the queath to my son Asa Dwelly one Dollar to be paid to him by my Executors out of my estate he having before received his proportion of my property. I do hereby give & bequeath to my Daughter Elizabeth Spalding two hundred Dollars & I do hereby give & bequeath to my Daughter Lucy ___ two hundred Dollars & I do give & bequeath to my Daughter Deborah Graham one hundred Dollars & I do give & bequeath to my grand Daughter Synthia Dwelly Daughter of my son Jedidiah Dwelly deceased two hundred Dollars & I do give & bequest to my Grandson James Graham one hundred Dollars to be paid to them in manner following that is to say I do hereby order & direct my two sons Abner Dwelly & Lemuel Dwelly within two years after my Death to pay into the hands of my executor Eight hundred Dollars as a Consideration for the one hundred acres of land which I have given them. I do declare that to be the Condition ___ which the de??? Of the land to them is made. I do also give & bequeath to my said two sons Abner & Lemuel all my ???? property ? household furniture except which shall remain after the payment of all my Debts & all costs that ? that shall arise in the settlement of my estate. I do give & bequeath to my three Daughters Elizabeth Lucy & Deborah & to my Grand Daughter Synthia Dwelly all my household furniture after the death of my wife & that this my last will & testament may be duly executed I do hereby appoint Abner Dwelly my son & Ebenezer Forte Esquire my Executors thereof – I do hereby order them to pay off all the legacies above mentioned as far as they shall receive the money from my two sons Abner & Lemuel – except to Synthia Dwelly & James Graham – each of their Legacies I do order my executors to retain until they shall arrive to the age of twenty one years and if it should happen that the said Abner Dwelly & the said Lemuel Dwelly shall not pay to my executor the said sum of eight hundred Dollars within two years after my Death I do hereby order ??? authorize my said Executors to sell the said one hundred acres of land for the purpose of paying off those Legacies & what sum of money it sells for more than the eight hundred Dollars I go give & bequeath the same to my said two sons Abner & Lemuel to be divided equally between them & do hereby order my Executors to pay the same to them in Witness whereof I have hereunto set my hand & seal the ninth day of November.
