Last Will and Testament Tobias Van Buren Town of Schodac |
In the name of God Amen, I Tobias Van Buren of the Town of Schodac & County of Rensselaer, being weak in body, but of sound mind and memory, blessed be Almighty God for the same, do make & publish this my last will and testament, in manner and form following -- that is to say --
First, I give and bequeath unto my beloved wife Jenney Van Buren, all and singular my real & personal estate of every kind whatsoever, except a farm whereon my son Henry now lives on in Schohary County, during her naturallife if she survives me --
Secondly ~ I give & bequeath to my son Harmon Van Buren after the death of my wife Jenney & myself, the farm on which I now live, to him, his heirs & assigns, for every [sic], with one equal half of all my horses, & cattle sheep & hogs; with all my farming utensils of every kind ~
Thirdly ~ I give to my son Tobias Van Buren one hundred pound current money of New York, to be paid to him by my son Harmon out of the estate I give him five years after our decease, with one equal half of all my cattle,
horses, sheep & hogs ~
Fourthly, I give & bequeath to my daughter Tanneky one hundred pound current money of New York to be paid to her by my son Harmon out of the estate above mentioned, five year after our decease & to live with my son
Harmon on the farm & have a hum [home?] as usual ~
Fifthly ~ I give & bequeath to my son John Van Buren, one hundred pound current money of New York, to be paid to him by my son Harmon out of the estate above described, five year after our decease ~
Sixthly ~ I give & bequeath my son Henry Van Buren the farm on which he now lives in Schohary county containing seventy eight & a half acres of land conveyed to me by William Cooper as agent for John Murrey, to him his heirs & assigns forever ~
Seventhly, I give to my son Peter Van Buren five pound to be paid to him by my son Harmon five year after our decease ~
And Lastly, I appoint Robert Woodworth, Cornelius Van Buren & Jon Miller as my Executors to this my last Will & Testament: In witness whereof, I have [here]unto set my hand & seal this eleventh day of May One thousand eight hundred & five

Be it remembered, that on the ninth day of February in the year of our Lord One thousand eight hundred & fourteen personally appeared before me David Allen Esquire, Surrogate of the said County of Rensselaer - Abraham Bliss & Samuel Bliss two of the subscribing witnesses to the Will of Tobais Van Buren late of the Town of Schodac in the said County deceased; who being duly sworn, declared that they did see the said Tobias Van Buren seal & execute the written instrument (of which the annexed is a copy) purporting to be the last Will & Testament of the said Tobias, bearing date the eleventh day of May in the year of our Lord One thousand eight hundred & five, and heard him publish & declare the same, as & for his last Will & Testament; that at the time thereof, he the said Tobias Van Buren was of sound disposing mind & memory, to the best of the knowledge & belief of the said Abraham & Samuel, and that the said Abraham & Samuel, together with Charles Townsend the other witness to the said will, severally subscribed their hands & names to the said will, as witnesses thereto, in the presence of the Testator and of each other ~
