Last Will and Testament Jacob Minick Town of Poestenkill |
The last will and testament of Jacob Minick late of the town of Poestenkill in the County of Rensselaer deceased together with the proofs thereof as a will of real and personal estate. Recorded June 21st 1887. Delivered to Executor Feb. 15, 1889.
In the name of God Amen I Jacob Minick of the town of Poesenkill in the County of Rensselaer and State of New York Farmer, Being of sound and perfect mind and memory (Blessed be almighty God for the same) do for the purpose of disposing of the property that I shall own at the time of my death make publish and declare the following to be my last will and Testament: that is to say:
First, I give and bequeath unto my said son Jacob Minick Junr all my clothes and wearing apparel: One good bed, and bedstead and bedding, for the same, sufficient for a change in both summer and winter: and the use and occupation of the Bedroom in the westerly corner of the one and half story part of my dwelling house where I now reside, He shall have a home at the dwelling house where I now reside, and be supported and maintained in sickness and in health out of the annual products and Incomes of the farm now owned by me and whereon I now reside containing one hundred acres of land and herein qfter devised to my daughter Mary Miller, now the wife of Lawrence Miller with good and wholesome food, clothing and all the necessaries for the comfort, doctoring, nursing, waiting upon and taking care of in time of sickness in a like manner that I have been accustomed to do and provide for him: all to be done and performed by my said daughter Mary Miller or the owner or occupant of said farm, for and during all the natural life of him the said Jacob Afinick Juar and at his death the said Mary Miller or the owner or occupant of said farm shall pay and defray all his funeral expenses for a decent and respectable burial including suitable and proper Grave stones to be placed at his grave:
Second, I give and bequeath unto my daughter Eliza Garner my good bed and bedstead and bedding for the same, sufficient for a change in both summer and winter: The use and occupation of the bedroom adjoining the lower hall in my dwelling house where I now reside for and during all her natural life time, she shall have a home at my said dwelling house and be supported and maintained in sickness and health out of the annual products and incomes of the farm now owned by me and whereon I now reside, containing one hundred acres of land and hereinafter devised to my said daughter Mary Miller now the wife of Lawrence Miller with good and wholesome food, clothing and all things necessary for her comfort, doctoring, nursing, waiting upon and taking care of in time of sickness at all times and in a manner that her condition and circumstances may require and in a manner as I have been accustomed to do and provide for her: all to be done and performed by my said daughter Mary Miller or the owner or occupant of said farm for and during all the natural life time of her the said Eliza Garner. And at her death the said Mary Miller or the owner or occupant of said farm shall pay and defray all her funeral expenses for a decent and respectable burial, including suitable and proper Grave stones to be erected at her grave:
Third, I give, bequeath, grant and devise unto my daughter Mary Miller now the wife of Lawrence Miller, all that certain farm pieces or parcel of land situate lying and being in the town of Poestenkill in the County of Rensselaer, N. Y. aforesaid. Being the same farm and premises now owned by me and whereon I now reside, and is part and parcel of the same farm or tract of land that Stephen Van Rensselaer (now deceased) conveyed to Peter Minick (also deceased) together with a strip of ground that I purchased of Munson Spencer, containing in all about one hundred acres of land be the same more or less, with the hereditaments and appurtenances thereunto belonging: To have and to hold said farm and strip of ground, with all and singular the hereditaments and appurtenances threunto belonging unto her the said Mary Miller her heirs, executors, administrators and assigns forever, subject, however, to the support and maintenance of the said Jacob Minick Junr and the said Eliza Garner and each one of them for and during the lifetime of them and each one of them as provided by the first and second clauses and items of this my last will and testament.
Fourth, For the purpose of securing the support and maintenance of my said son Jacob Minick Junr and my daughter Eliza Garner, and each one of them, and the faithful performance of the same in all respects by the said Mary Miller or the owner or occupant of said farm, as particularly specified and provided in and by the first and second clauses or items of this my will, I do hereby charge the support and maintenance of the said Jacob Minick Junr and Eliza Garner and each one of them upon and make the same a lien on the farm above devised to the said Mary Miller for and during the lifetime of the said Jacob Minick Junr and Eliza Garner and each one of them.
Fifth, I give, bequeath, grant and devise unto my said daughter Mary Miller all that certain house and lot commonly known and called the "Margaret Kilmer" house and lot: situate, lying and being in the town of Poestenkill and adjoining my home farm and containing about six tenths of an acre of land be the same more or less with the hereditaments and appurtenances thereunto belonging. To have and to hold said house and lot with the hereditaments and appurtenances thereunto belonging unto her the said Mary Miller her heirs, executors, administrators and assigns forever.
Sixth, I also give, bequeath, grant and devise unto my said daughter Mary Miller the undivided one half part of that certain farm, piece or parcel of land, situate lying and being in the town of Poestenkill in the county of Rensselaer, N. Y. with the hereditaments and appurtenances thereunto belonging containing about forty and three fourth acres of land be the same more or less, being the same land and premises that purchased of William H. Ferguson and wife by deed dated on the nineteenth day of February in the year 1877 and recorded in the Rensselaer County Clerk's Office in Book of Deeds Number 173 at page 519&c. To have and to hold the undivided half of said farm with all and singular the hereditaments and appurtenances thereunto belonging unto her the said Mary Miller her heirs, executors, administrators and assigns forever.
Seventh, I direct my said daughter Mary Miller to take care of my Burial lot and erect or cause to be erected a suitable grave stone at the grave of my wife lately deceased, if I have not erected one in my life time, also to erect or cause a similar one to be erected and placed at my grave.
Eighth, I give and bequeath unto my daughter Mary Miller all the rest of my personal property of every name, kind, quality and nature whatsoever and wheresoever the same maybe after payment thereout of all my just and lawful debts, funeral charges and expenses and expenses of selling my estate. To have and to hold all my singular said personal property and every part and parcel, thereof not otherwise disposed of after paying out of as aforesaid unto my said daughter Mary Miller her heirs, executors, administrators and assigns forever.
Ninth, I hereby nominate, constitute and appoint my son-in-law Lawrence Miller sole executor of this my last will and testament hereby revoking and annulling all former and other will or wills by me heretofore made and published. In witness whereof I Jacob Minick have hereunto set my hand and seal this tenth day of November in the year of our Lord one thousand eight hundred and seventy nine.
