The last Will & Testament & codicil thereto of Cornelius Dubois late of the town of North Greenbush in the County of Rensselaer deceased with the proof thereof as a will of Real & Personal Estate recorded September 1st 1868.

Will delivered to E. J. Ford Exc September 22 1868.

In the name of God Amen I Cornelius Dubois of the town of North Greenbush County of Rensselaer and state of New York farmer being in good health of body and of sound & perfect mind and memory blessed he almighty God for the same Do make and publish this my last Will & Testament and do bequeath and dispose of my worldly estate as follows: That is to say: It is my will that my executors I shall herein after name shall pay out of estate all my just debts funeral expenses and the charges and cost of settling my estate and for two tombstones one for myself and one for my wife worth at least fifty dollars each to be erected at our respective graves in my lot in the Bloomingrove Cemetery and it is my will that my heirs and their families shall have the privilege to bury in the said lot in said Cemetery

Item First I give bequeath and devise to my beloved wife Catherine my homestead farm on which I now live in said town of North Greenbush with the buildings therein and all the personal property that I may be possessed of at my decease In trust nevertheless for her use and benefit during her natural life and after her decease the said homestead farm shall be either kept by someone of my heirs or I authorize my executors to sell the same as shall be best for the interest of my estate And it is my will that all the personal property that shall remain after my wife's decease shall be disposed of as I shall hereafter order and direct and I also order my executors to sell and convey two woodlots I own on the mountain unless I shall have disposed of the same in my lifetime

ltem Second I give & bequeath to son son Frederick or his heirs Two thousand dollars to be paid out of my estate within eighteen months after my wife's decease when my said estate shall be settled

Item Third I give and bequeath to my son Daniel or his heirs Three thousand five hundred dollars to be paid out of my estate within eighteen months after my said wife's decease when my said estate estate shall be settled

Item Fourth I give & bequeath to my son Sidney or his heirs Two thousand dollars to be paid out of my estate within Eighteen months after my said wife's decease when my estate shall be settled

Item Fifth I give and bequeath to my daughter Emily now wife of Eliakim J. Ford or her heirs Two thousand dollars to he paid out of estate within eighteen months after my said wife's decease when my estate shall be settled and I also give and devise to my daughter Emily or her heirs the house and lot where she now lives in the fifth ward of the city of Troy & which I purchased of John B. Ford

Item Sixth After paying the legacies before mentioned and paving all debts claims charges and cost of settling my estate as first above mentioned I give bequeath and devise the residue of my estate to my said sons or their heirs and my said daughter or her heirs to be divided in equal shares between them to wit: One fourth part to each of my sons Frederick, Daniel and Sydney and one fourth part to my daughter Emily. And it is my will enjoin and order that my said sons & daughter Emily jointly pay when my estate is settled the following legacy to Elouisa Myers the adopted daughter of my deceased daughter Catherine Two hundred dollars but if the said Elouisa is not at said settlement 21 years of age then it is my will and I expressly direct that said sum of Two hundred dollars be kept on interest for her benefit until she shall have attained to said age of twenty one years and be then paid to her with the interest. Nevertheless if said Elouisa should die before she is twenty one years of age then & in that case this bequest to her shall be null and void

Item Seventh I do hereby authorize and impower my Executors to sell and convey any or all my real estate not herein before fully disposed of by devise after the death of my wife and not before

And Lastly I do constitute and appoint my beloved wife Catherine Executrix and my trusty son-in-law Eliakim J. Ford and Columbus Sharp Executors of this my last Will & Testament revoking all other wills by me made confirming & ratifying this and in order that there shall be no misapprehension of my meaning in regard to said Elouisa Myers I declare that I intend and it is my will that the said sum of Two hundred dollars enjoined ordered my sons and daughter to jointly pay to her as an absolute bequest to her which I order and direct my executors to fulfill in case she lives to the age of twenty one years as aforesaid and to keep the same on interest as thereinbefore stated

In witness whereof I have hereunto set my hand and seal and declare this to be my last Will and Testament in the presence of the witnesses named below this twentieth day of December in the year of Our Lord one thousand eight hundred and sixty two

The above instrument written on one sheet of paper was at the date thereof signed sealed published and declared by the said Cornelius Dubois as & for his last Will & Testament in the presence of us who at his request & in his presence & in the presence of each other have subscribed our names as witnesses thereto
