The last Will and testament of Ann Weiderwax late of the town of Nassau, County of Rensselaer deceased together with proofs thereof as a Will of personal estate. Recorded: July 23d 1890. Will delivered to Executor December 20t 1893.
Will
I Ann Weiderwax of the town of Nassau Rensselaer County New York being of sound mind and memory do make ordain, publish and declare ther to all my Last Will and Testament that is to say:
First: After all my lawful debts are paid and discharged. I give devise and bequeath unto my brother Abram Weiderwax the sum of Five Hundred dollars.
II: I give devise and bequeath to my brother Morgan Weiderwax , the sum of Five Hundred dollars.
III: I give devise and bequeath to my nephew Charles I. Weiderwax son of

my deceased brother Henry Weiderwax Jr. the sum of Five Hundred dollars.
IV: I give devise and bequeath to Eva Ann Stevens, Mary Jane Rockefeller, Caroline Smith and Nancy A. Smith daughters of my deceased brother Andrew Weiderwax, each the sum of one hundred dollars.
V: I give devise and bequeath to Charles Van Allen and Frank Van Allen sons of my niece Anna Van Allen the sum of Two Hundred dollars each, the said sum of two hundred dollars to be paid them upon their attaining the age of twenty one years by mu executors and trustees hereinafter appointed.
VI: The furniture in my house and possessions of my said brother Abram Weiderwax. I give and bequeath to him.
VII: The furniture, bed and bedding in the house and possession of my said nephew Charles I. Weiderwax I give devise and bequeath to him.
VIII: I give devise and bequeath my wearing apparel and jewelry to Charlotte and Anna Weiderwax wife and daughter of my said brother Abram Weiderwax.
IX: I hereby direct my executor hereinafter appointed to invest the said sums by me devised to Frank Van Allen and Charles Van Allen and to keep said sums invested until the said Charles Van Allen and Frank Van Allen shall reach the age of twenty one years, and upon attaining the age of twenty one years to pay the sum of Two Hundred dollars together with the interest thereon to each of them.
X: I hereby give and devise all the rest, residue and remainder of my property to Abram Weiderwax and Charles I. Weiderwax above named.
XI: In case of the death of either of the legates named under this my last Will and Testament I hereby direct the amount devised to them be paid to their next of kin. Likewise I make and constitue and appoint Abram Weiderwax and Charles I. Weiderwax to be executors of this my last Will and testament hereby revoking all former Wills by me made.
In witness whereof I have hereunto subscribed my name and affixed my seal this (blank) day of September in the year of our lord one thousand and eight hundred and eighty five.

The above instrument consisting of two sheets was at the date thereof subscribed by Ann Weiderwax in the presence of us and each of us, she at the time of making such subscription, acknowledged that she made the same and declared the said instrument so subscribed by her to be her last Will and testament.
Whereupon we then and there at her request and in her presence and the presence of each other subscibed our names as witnesses there to.

NOTE FROM SUBMITTER: What a wonderful document for researching a family history. She not only identifies her siblings, but deceased members of her family and the married names of nieces, etc. In my own research it cleared up the name and marriage of one of her nieces I was missing. Ann had previously inherited the estate of her sister Harriet in 1872.
Their parents were Hendrick or Henry Weiderwax (1786-1868) and wife Albertina Wilson (1787-1851). The surname spelling of Weiderwax is one of over 60 variations already identified. The most common being Weatherwax, Wetherwax, Witherwax, Weatherwalk, etc.
