The Last Will and Testament of MATTHEW (MATTHIAS) BRUST, deceased,
Recorded 24 August 1835

I, Matthew Brust, of the Town of Brunswick, in the County of Rensselaer and State of New York, do make and publish this my last Will and Testament, in manner and form following, that is to say:

First: I give and bequeath unto my beloved wife Mary [the former Anna Maria Wagar] the use and profits only, of the one third part of all my freehold Estate, all and singular my household furniture, the one equal half of the dwelling house wherein I now reside, one cow and three sheep during her natural life; which bequest made to my wife Mary is in full satisfaction of her right of dower, which she, the said Mary, hereafter may have a right to claim in my Estate both Real & Personal.

I give and bequeath to my son Joseph BRUST the sum of one hundred dollars.

I give and bequeath unto three of my daughters, Caty SHAVER, Christeen KLICKNER, and Eliza, the sum of three hundred Dollars, equally to be divided between them, share and share alike. I give and bequeath my wearing apparel to my two sons Joseph and William. I give and bequeath to my daughter Eliza one cow, one heffer, two years old, and three sheep, when thereunto requested by her the said Eliza; which said several Legacies or sum of money, I will and order shall be paid to the said respective legatees, within ten years after my decease, if not by me paid, or articles advanced for that purpose, which legacies are to be paid in the following manner: Forty Dollars yearly and every year which will make ten Dollars to each of the above named legatees yearly. I also give and bequeath to my daughter Eliza the sum of seventy Dollars worth in household stuff for house keeping, if not by me advanced.

I give and devise to my daughter Sarah HOWARD the one equal half of the farm whereon I now reside, being that part which has lately been surveyed by Martin Springer at the request of Peter HOWARD, her husband, containing abought (sic) Thirty-six acres of land to have and to hold to her, the said Sarah, her heirs and assigns forever, subject however to the payment of three hundred Dollars to be paid within ten years after my decease Thirty Dollars yearly and every year.

I give and devise to my friend Adam FILE the other half of the farm whereon I now reside, situate in the Town of Brunswick, in the county of Rensselaer, which will include all the buildings on said farm, to hold to him, the said Adam File, his Executors and assigns in trust for my son William; and after the decease of him, the said William, I give and devise the same to the children of him, the said William, to hold to them the said children, their heirs and assigns forever, share and share alike. And in case the said William should die leaving no lawful issue, then and in that case, my will is that the land devised to my son William shall be held in fee by the survivors of the above named legatees, share & share alike, subject however, to the payment of one hundred Dollars within ten years after my decease, ten Dollars to be paid yearly and every year. As to all the rest residue and remainder of my Estate, goods and chattels, lands, and Tenements whatsoever and wheresoever the same may be situated, I give and bequeath the same to my six children above named, to hold to the said children, their heirs and assigns forever, share and share alike, subject however, to all demands against my Estate and the payment of the above named legacies.

It is my will that my daughter Eliza shall and may have her home at my dwelling house, and in case of sickness, be supported out of my Estate, until she, the said Eliza, shall arrive at the age of twenty-one years, or change her condition by marriage.

I do hereby authorize and empower my Executors or either of them hereinafter named, to grant, bargain, sell, release and convey in due form of law of Deed or Deeds the above resited (?) lands devised to my son William and when sold, apply the sales thereof to satisfy the above named legacies according to their rights respectively. I hereby appoint Mallikate M. FILE, Esquire and Andrew HANER Executors of this my last Will and Testament, hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal, the seventh day of April, one thousand eight hundred and twenty-seven.

Signed, sealed, published, and declared by the above named Matthew Brust to be his last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the Testator.
