as will of Real and Personal Estate
Recorded October 18th 1852

Will

This is the last will and testament of me Dennis Cassin of the Village of Greenbush in the County of Rensselaer and State of New York.

In the name of God amen I the said Dennis Cassin being weak in body but of sound mind memory and understanding do make publish and declare this my last will and testament as follows, to wit:

First, I order and direct that all my just debts and funeral expenses be paid by my Executrix and Executors hereinafter named out of my estate, as soon after my decease as may be.

Second, I give devise and bequeath unto my beloved wife HONORA all the real and personal estate of which I may die possessed of every nature and kind and wheresoever situate during her natural life and while she remains my widow, for her support, and for the support education and maintenance of our children.

Third, I give devise and bequeath unto my said children, Catharine, Mary, Elizabeth, Michael, William, John and Dennis, all my real and personal estate that may be left or remain after their support and education, on the death of my said wife. To be divided between them share and share alike on the youngest child attaining the age of twenty one years.

Fourth, In case of the death of either of my said children, without leaving lawful issue, I order and direct that the share or shares of such child or children shall be divided between my surviving children share and share alike.

Fifth, I hereby authorize and empower my said Executrix and Executors, or a majority of them, to lease for a term of years, or to mortgage, or to sell and dispose in fee, by good and sufficient instrument all or any portion of my said real estate.

Sixth, After the death of my said wife, if it shall appear to my surviving Executors or Executor, to be for the interest of my children to divide the balance of my property then remaining between them as hereinbefore provided, and not wait until the youngest shall have attained the age of twenty one years, they or he are hereby authorized and empowered so to do.

Seventh, I do hereby nominate constitute and appoint my said wife Honora, my brother John CASSIN and Thomas HALLE(R?)NAN Executrix and Executors of this my last Will and Testament and guardians of my said children, hereby revoking all former wills by me made.

In witness whereof I the said Dennis Cassin the testator have to this my last will and testament contained on this and on the preceding page subscribed my name and affixed my seal this fourth day of October in the year of our Lord one thousand eight hundred and fifty two.

Testament of Dennis Cassin deceased }

County of Rensselaer ss:

Matthew McMahon of Albany City and Patrick Rigney of the town of Greenbush in the County of Rensselaer being duly sworn in open court, doth depose and say and each for himself says that he is a subscribing witness to the last Will & Testament of Dennis Cassin, late of the town of Greenbush in the County of Rensselaer, deceased. And that the said Dennis Cassin did, in the presence of this deponent, subscribe his name at the end of the instrument which is now shown and exhibited to this deponent, and which purports to be the last Will and Testament of the said Dennis Cassin and which bears date on the fourth day of October in the year of our lord one thousand eight hundred and fifty two. And that the said Dennis Cassin did at the time of subscribing his name, as aforesaid, declare the said instrument to be his last Will and Testament; and this deponent did thereupon subscribe his name at the end of the said Will as an attesting witness thereto, at the request of the said testator. And that at the time, when the said testator subscribed his name as aforesaid, the said Dennis Cassin was of sound mind and memory, was of full age to execute a will, and was not under any restraint, but competent in all respects to devise real estate. And that these deponents severally did at the same time subscribe their names to the said Will as witnesses thereto, at the request of the said testator in his presence, and in the presence of each other, and further this deponent saith not.

And that the same was duly recorded as a Will of Real & Personal Estate this 18th day of October 1853.
