The Last Will and Testament of AMOS BRUST, deceased,
with the proofs thereof, as a Will of real and personal Estate
Recorded June 8th, 1854

WILL

In the name of God, Amen. I, Amos BRUST, of the Village of Lansingburgh, County of Rensselaer and State of New York, being of sound mind and memory, do make, publish and declare this my last will and testament in manner following, That is to say -

First: After paying my funeral expenses and all of my just debts, I give and bequeath to Thomas LAPE of said Village of Lansingburgh who is my executor hereinafter named, all of my property, real and personal and chattels real wheresoever the same may be, in trust for the use, benefit, and maintenance of my son Albert G. BRUST, while he shall remain a minor; and that after my said son shall become of age, the trust hereby created shall cease and my said son Albert G. and his children shall then take in fee all of my property of every name and kind.

Second: In case my said son shall die before he becomes of age and without children or child, then and in that case, I give and bequeath all of my said property in fee to Emeline E. EYCLESHEIMER, a sister of my wife, deceased, and her heirs and assigns. And the said trust shall cease, and it is my wish that said Emeline E. shall take charge of my said son and bring him up.

Lastly: I do hereby appoint the said Thomas LAPE my sole executor of this my last Will and Testament, hereby revoking all former wills made; and further I do hereby authorize my said Executor to sell and dispose of all or any of my real estate and chattels real and convert the same into money if he shall deem it best; and the avails coming from each sale shall be invested by him again in some secure and permanent way unless my said son shall require a portion thereof besides the annual income for his support and education, which may be used for that purpose by my said Executor, and I also direct my said Executor to pay the income of my said property as often as he shall receive the same and such portions of the principal of my said property if necessary for the support of my said son to said Emeline E. EYCLESHEIMER as long as she shall use the same for the maintenance and education of my said son.

The above instrument consisting of a part of a sheet was at the date thereof signed, sealed, published, and declared by the said Amos BRUST as and for his last will and testament in presence of us, who at his request, and in his presence, and in the presence of each other, have subscribed our names as witnesses thereto.

PROOFS

Surrogate Court

In the matter of proving the Will and Testament of Amos BRUST, deceased

County of Rensselaer - S.S.

Alson D. Hull and Hiram Bleekman of the town of Lansingburgh in the County of Rensselaer, being duly sworn in open court, doth depose and say, and each for himself says, that he is a subscribing witness to the last Will and Testament of AMOS BRUST, late of the town of Lansingburgh in the County of Rensselaer, deceased. And that the said Amos Brust did in the presence of these deponents ... and which purports to be the last Will and Testament of the said Amos Brust and which bears the date of the 15th day of May in the year of our Lord One thousand eight hundred and fifty four. And that the said Amos Brust did at the time of subscribing his name as aforesaid declare the said instrument to be his last Will and Testament, and these deponents thereupon did subscribe their names at the end of the said will as attesting witnesses thereto at the request of the said Testator. And that at the time when the said Testator subscribed his name as aforesaid the said Amos Brust was of sound mind and memory, was of full age to execute a will, and was not under any restraint but competent in all respects to devise Real Estate. And that these deponents severally did at the same time subscribe their names to the said will as witnesses thereto at the request of the said Testator in his presence and in the presence of each other. And further these deponents say not.
