Will of Morgan L. ALLEN

Let it be remembered that I MORGAN L. ALLEN of the Town of Petersburgh and the County of Rensselaer in the State of New York considering the uncertainty of this mortal life and being of sound and perfect mind and memory do make and publish this my last will and testament in the manner and form as follows that is to say

to give and bequeath unto my beloved wife FANNY all of my property during her life and after her decease I give and bequeath to my brother COMFORT one half and the other half to my sister WATY

I further ___(?) and appoint DAVID G. MASON(?) and FANNY ALLEN my sole executors of this my last will and testament.

In witness whereof I have hereunto set my hand and seal this sixteenth day of April one Thousand eight hundred and fifty one in presence of these witnesses

In the matter of Morgan L. Allen deceased.}
County of Rensselaer} ss.

ABRAM N. ALLEN and BENJAMIN NICHOLS of the town of Petersburgh in the County of Rensselaer, being duly sworn in open Court, doth depose and say and each for himself says that he is a subscribing witness to the last Will and Testament of Morgan L. Allen late of the town of Petersburgh in the County of Rensselaer deceased. And that the said Morgan L. Allen did, in the presence of this deponent, subscribe his name at the end of the instrument which is now shown and exhibited to this deponent, and which purports to be the last Will and Testament of the said Morgan L. Allen which bears date on the sixteenth day of April in the year of our Lord one thousand eight hundred and fifty one, and that the said Morgan L. Allen did at the time of subscribing his name, as aforesaid, declare the said instrument to be his last Will and Testament; and this deponent did thereupon subscribe his name at the end of the said Will as an attesting witness thereto, at the request of the said testator. And that at the time, when the said testator subscribed his name as aforesaid, the said Morgan L. Allen was of sound mind and memory, of full age to execute a Will, and was not under any restraint, but competent in all respects to devise real estate. And that these deponents severally did at the same time subscribe their names to the said Will as witnesses hereunto, at the request of the said testator in his presence, and in presence of each other; and further this deponent saith not.

Be it remembered, that on the day and date hereof, the last Will and Testament of Morgan L. Allen late of the town of Petersburgh deceased, (being the foregoing written instrument) was duly proved before George T. Blair, Surrogate of the said County, according to law, and as for the last Will and Testament of the real and personal estate of said deceased, which said Inst. Will and Testament, (BLANK) and the proofs and examinations taken thereon, and recorded in this Office Book of Records No. 41, Pages 327 & 328.

In Testimony Whereof, I have hereunto subscribed my name and affixed my official Seal, this sixth day of October 1851 [sic].
