Last Will and Testament

The late Lin Van Buren transcribed this will verbatim from the original as filed in Rensselaer County NY Surrogate Court Probate File 312; this will is also recorded in Rensselaer Co NY Surrogate Court Will Book 116 on page 511. The testator was born in Rensselaer Co NY and died on 26 January 1887 in Schodack, Rensselaer Co NY at the age of 79 years leaving a widow, Eleanor.

Will of Real and personal Estate

In the name of God, Amen: I, William H. MORRIS of the Town of Schodack County of Rensselaer and State of New York of the age of sixty-seven years, and being of sound mind and memory do make publish and declare this my last will and testament in manner following, this is to say -

First - I give and bequeath to my daughter Amanda WALLY [sic] five hundred dollars to be paid her one year from the date of my death without interest but in case my said daughter Should die then the said five hundred dollars is to [be] paid to her heirs.

Second
I give and bequeath unto my daughter Mary J. YAULDEU [sic] the sum of five hundred dollars to be paid her one year after my death without interest - but in case my said daughter should die then the said five hundred dollars is to be paid to her heirs.

and lastly
I give and bequeath unto my son John H. MORRIS the farm on wish [sic] I now live wish [sic] is Bounded and described as follows to wit:
on the North by lands formerly owned by Cornelius SNOOK now deceased, SAGENDORPH and Hiram VAN BUREN,
on the East by lands of William MOUL,
on the South by lands of Joseph D. MORRIS &
on the West by lands owned by Titus HUSTED now deceased
and said to contain Eighty acres of land be the same more or less, together with all the hereditaments and appurtenances thereunto belonging as in any wise appertaining: to have and to hold the premises above described to the said John H. Morris his heirs and assigns forever.

I also give and bequeath the remainder of my personal Estate goods and Chattels of what nature or kind soever to my said son John H. Morris whom I hereby appoint sole Executor of this my last will and testament, hereby revoking all former wills by me made.

I further order and direct that in case there should not be personal property sufficient to pay the aforesaid legacies that the same share be paid out of my real Estate.

In witness whereof I have hereunto set my hand and seal this 7th day of October 1875.

Morris as and for his last will and testament, in presence of us, who, at his request and in his presence and in the presence of Each other, have subscribed our names as witnesses thereto:

SURROGATE'S COURT.

In the matter of proving the last Will and Testament of William H.
Morris of Schodack deceased.

To WILLIAM LORD, Esq., Surrogate of the County of Rensselaer:

The petition of John H. MORRIS sole executor named in the last Will and Testament of William H. MORRIS late of the town of Schodack in the County of Rensselaer and State of New York, deceased, respectfully showeth, on information and belief, that the said William H. Morris died on or about the 26th day of January 1887 at the town of Schodack in the County of Rensselaer aforesaid, which was the place of his residence at the time of his death. That the instrument now presented and shown to your petitioner purporting to be the last Will and Testament of said deceased, and bearing date upon the 7th day of October 1875, your petitioner verily believe to be such last Will and Testament of said deceased and that the said instrument purporting to be such last Will and Testament of said deceased relates to both real and personal estate.

And your petitioner further show that the said deceased left surviving

Your petitioner John H. MORRIS a son of Schodack Rens Co N. Y.
Elanor MORRIS his widow of Schodack Rens Co N. Y.
Mary J. YADEAU a daughter of Nassau " " " [Rens Co N. Y.] &
Amanda WALLEY a " " [daughter of] Stephentown " " " [Rens Co N. Y.].

and who are all and the only heirs-at-law and next of kin of the said deceased.

and it appearing that Eliner MORRIS the widow of said of said [sic] deceased was a person of unsound mind Alex B. Slocum of Troy, N. Y. upon filing this written consent was appointed Special Guardian to take care of her interests in these proceedings and appeared in person for her....
